Terms of Service
These terms are an agreement between you and Animately, Inc. ("Animately", "we", "us") covering your use of animately.co and the Animately web app (together, the "Service"). By using the Service you accept these terms. If you do not accept them, do not use the Service.
The Service
Animately provides tools for creating, editing, and compressing GIFs. Core tools are free to use. Premium features, including our server-side compression engine, are paid for with credits purchased through the Service. We may add, change, or remove features as the Service evolves.
Accounts
Some features require an account. Keep your login credentials secure: activity under your account is your responsibility. Give us accurate information and keep it current. You must be at least 13 years old to use the Service.
Credits and payments
Premium features consume credits. Credit packs are purchased through Stripe, and prices may vary by region and currency. Credits are tied to your account and cannot be transferred or exchanged for cash. Purchases are non-refundable except where a refund is required by applicable law (including consumer protection law in your country) or where we choose to offer one.
Your content
You keep all rights to the files you process with the Service. You give us the limited permission needed to receive, process, and return your files, solely to provide the Service to you. We do not claim ownership of your content and we do not use it for anything beyond delivering the Service.
You are responsible for the content you process. Only process files you have the right to use.
Acceptable use
Do not use the Service to:
- process or distribute content that is unlawful, infringing, or harmful;
- probe, overload, or disrupt the Service or its infrastructure;
- resell or provide automated bulk access to the Service without our written agreement;
- attempt to reverse engineer non-public parts of the Service, except where the law allows it.
We may suspend or terminate accounts that violate these rules.
Our property
The Service, including its software, design, and branding, belongs to Animately and its licensors. These terms do not give you any right to use the Animately name or branding.
Third-party services
The Service is built on third-party providers (hosting, payments, analytics, support tools) described in our Privacy Policy at animately.co/privacy. Their availability affects ours, and their terms apply to the parts of the Service they provide.
Disclaimers
The Service is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or that any particular compression result will be achieved. Nothing in these terms excludes rights you have under consumer protection law that cannot be excluded by agreement, including consumer guarantees under the Australian Consumer Law.
Limitation of liability
To the extent permitted by law, Animately is not liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill, arising from your use of the Service. To the extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us in the twelve months before the claim arose, or USD 50 if you have paid nothing.
Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate access to the Service where these terms are violated, where the law requires it, or where we discontinue the Service. Sections that by their nature should survive termination (including Your content, Disclaimers, and Limitation of liability) survive.
Governing law
These terms are governed by the laws of Victoria, Australia, and disputes are subject to the exclusive jurisdiction of the courts of Victoria, Australia, except where the law of your country of residence gives you the right to a different forum.
Changes to these terms
If we change these terms, we will update them here and adjust the effective date above. Material changes will be flagged more prominently on the site. Continuing to use the Service after a change takes effect means you accept the updated terms.
